Terms of Use

1. Description of the service

ProfitPilotPro (https://profitpilotpro.fr) is an analytics dashboard SaaS for e-commerce merchants. It brings together Shopify data (via OAuth) and ad spend (Meta, TikTok, Google, etc.) and calculates profitability metrics (net profit, ROAS, etc.).

The service is published by KALMIE (SASU), 60 rue François 1er, 75008 Paris, France.

2. User account

Access requires creating an account with a valid email address. You are responsible for keeping your login credentials confidential and for all activity carried out from your account.

You agree to provide accurate information and to create only one account per legal entity or natural person, unless otherwise agreed in writing for multi-user plans (Agency).

3. Free trial and plans

A 14-day trial is offered with no credit card required, with extended access to features (Trial plan).

At the end of the trial, you subscribe to a paid plan (Starter, Pro or Agency) through Shopify. A connected Shopify store is required. Without a subscription, the account is soft-locked: premium modules are locked and basic data remains available in read-only mode, with a prompt to choose a plan from Billing.

4. Pricing, renewal and billing

Current prices, including VAT, are displayed on the website and on the Billing page. Payment goes through Shopify App Pricing: Shopify collects the ProfitPilotPro subscription on the store's invoice. We do not store any card numbers.

An earlier subscription that is still active continues to be charged by Stripe, our former payment provider, until it is canceled. Its invoices are available from the Billing page. No new subscriptions are opened there.

The subscription renews automatically (monthly or annually) until canceled.

Commercial guarantee: 60-day money-back guarantee (Terms of Sale §6). Statutory right of withdrawal: 14 days (Terms of Sale §8).

5. Cancellation

You can cancel a paid subscription at any time from your Shopify admin (Settings → Apps and sales channels). Cancellation takes effect at the end of the current period. After the 60-day guarantee, no prorated refunds are given — see the Terms of Sale.

An earlier subscription charged by Stripe does not appear in the Shopify admin: the account owner cancels it from Dashboard → Billing ("Cancel plan" button), effective at the end of the period already paid. Any refund granted on that subscription is paid to the original payment method.

You can delete your account from Settings. Data is retained as described in the Privacy Policy, then erased or anonymized.

6. Permitted use and prohibited conduct

You agree to use the service in good faith and not to:

• Use the service for any unlawful or unauthorized purpose
• Attempt to access other users' data or circumvent security measures
• Reverse-engineer, scrape or intentionally overload the infrastructure
• Resell or sublicense access without written consent
• Transmit third-party personal data without an adequate legal basis

7. Intellectual property

The software, interface, algorithms and the ProfitPilotPro brand remain the property of KALMIE. Your business data (orders, campaigns, etc.) remains yours; you grant us a limited license to process it in order to provide the service.

8. Limitation of liability

KALMIE provides the service with due care. It cannot be held liable for: scheduled maintenance, unavailability of third-party APIs, inaccuracies in source data, or financial losses resulting from your business decisions. Liability cap: the total amount paid over the last 12 months.

9. Personal data

Your data is processed solely to provide the service — it is never resold for third-party advertising purposes. Details: Privacy Policy.

10. Governing law

French law applies. The courts within the jurisdiction of Paris have jurisdiction, after an attempt at amicable resolution.
